Transaction Broker vs Single Agent: Which should I use?

At Easy Realty, Transaction Broker is the default and preferred agency relationship. Single Agent representation is allowed but should be used intentionally and only in limited circumstances. Florida law presumes a Transaction Broker relationship unless a Single Agent relationship is clearly established using the proper disclosure.

Transaction Broker (default at Easy Realty)

A Transaction Broker provides limited representation and is appropriate for most Easy Realty transactions. Transaction Broker duties include dealing honestly and fairly, using skill, care, and diligence, presenting all offers and counteroffers in a timely manner, disclosing known facts that materially affect value, and accounting for all funds. Transaction Broker is appropriate for most buyer transactions, including first‑time buyers, cash purchases, family referrals, and standard residential deals.

Single Agent (situational)

A Single Agent owes full fiduciary duties to the client, including loyalty, confidentiality, and obedience. Single Agent representation is not automatic, must be intentionally established with the correct disclosure, and increases legal and compliance risk. Single agency should only be considered when the client specifically requests fiduciary representation and there is a clear reason Transaction Broker duties are insufficient.

Common misconception

Being a first‑time buyer, family member, or close personal contact does not require Single Agent representation. These situations often carry higher risk if expectations are not clearly documented. Transaction Broker is still appropriate in most cases.

Important considerations

Once a Single Agent relationship is established, it cannot be casually changed without a formal transition disclosure. Errors may be evaluated as fiduciary breaches, increasing liability for both the agent and brokerage. For this reason, Easy Realty treats Single Agent representation as situational, not standard practice.
